Executive Order (EO) 13836, Developing Efficient, Effective, and Cost-Reducing Approaches to Federal Sector Collective Bargaining, signed by the President on May 25, 2018, requires authorities to submit any collective agreement (CBA) and its expiry date within 30 days of the effective date of the CBA. EO 13836 also requires the OPM to make these CAS publicly available on the Internet. This promotes transparency by allowing the public to consult the types of agreements between federal sector agencies and unions. Agencies are also required to file arbitral awards within 10 working days of receipt of the OPM. The OPM has issued a memorandum on the publication of the CBA database, which contains guidelines on the filing requirements of authorities for BCAs and arbitral awards. Staff of the Agency for Labour Relations or any other appropriate personnel may register as a user and submit CBAs and arbitration awards through the OPM Labor Relations Document Submission Portal. Once approved, Agency users can file arbitration decisions directly on this application. CBAs must not contain signatures, individual names, or other personal identifiers. Agencies can simply delete the signature page of cbAs or blacken the signatures, names and other personal identifiers of the CBAs. Please note that all BCAs must be submitted in a PDF file format (portable document format) that complies with the standards of Section 508 of the Rehabilitation Act of 1973 as amended (29 U.S.C. § 794(d) and 36 CFR Part 1194). Arbitral awards do not require compliance or obscurity in accordance with Section 508, but must be available in a searchable format. For more information on the filing of documents, please refer to the CBA Database Publication Submission.
